Terms and Conditions

Last Updated: October 4, 2026

Welcome to Zurca Marketing accessible at https://zurca.com/ (“Zurca,” “we,” “us,” or “our”).

These Terms & Conditions (“Terms”) govern your use of the Zurca website, the Free Website Program, website development services, Website Hosting & Care services, Client Portal, and related products and services.

By accessing our website, submitting an application, activating a website project, purchasing a service, creating an account, or otherwise using our services, you agree to these Terms.

If you do not agree to these Terms, please do not use our services.

1. The Free Website Program

The Zurca Free Website Program provides eligible businesses with the opportunity to receive professional website design and development with a $0 website development fee for the website package included in the program.

The Free Website Program is an application-based program.

Submitting an application does not guarantee acceptance.

Zurca reserves the right to accept or decline applications based on project requirements, business needs, available capacity, technical requirements, program suitability, or other reasonable considerations.

We are not obligated to provide a reason for declining an application.

2. What the Free Website Includes

Unless otherwise stated in your website offer, the standard Free Website Program package includes:

  • One professional single-page business website
  • Up to five website sections
  • Professional WordPress website design and development
  • Mobile-responsive design
  • Basic on-page website setup
  • A design direction selected from available options presented to the client
  • Integration of client-provided business information and approved content
  • Standard website functionality appropriate for a small business informational website
  • The number of revision rounds specified in your website offer or Client Portal
  • Access to the Zurca Client Portal during the project where applicable

The included website has a $0 development fee.

The Free Website Program does not mean that all products or services provided by Zurca are free.

3. Website Hosting & Care

Activation of a Free Website Program project requires enrollment in the applicable Website Hosting & Care plan, currently offered at $149 per year, unless a different price is clearly disclosed in your offer before purchase.

Website Hosting & Care is a recurring service and may include services such as:

  • Website hosting
  • WordPress-related maintenance
  • Routine software updates
  • Basic website care
  • Security-related maintenance
  • Technical hosting support
  • Other services described in the applicable plan or offer

The applicable price and renewal terms will be displayed before checkout.

By purchasing a recurring Website Hosting & Care plan, you authorize the applicable payment provider to charge the payment method associated with your account for renewals unless the service is canceled in accordance with these Terms.

4. Optional Website Upgrades

Accepted applicants may be offered optional upgrades or additional website features.

These may include additional pages, sections, features, functionality, design enhancements, or other development services.

Optional development upgrades are not included in the $0 development fee unless specifically stated otherwise.

The price of each selected upgrade will be disclosed before checkout.

Unless explicitly identified as recurring, development upgrades are one-time charges and do not renew with the Website Hosting & Care plan.

5. Pricing and Payment

All applicable prices will be disclosed before purchase.

Depending on your selections, your checkout total may include:

  • Website Hosting & Care
  • Optional development upgrades
  • Additional services
  • Applicable taxes or fees where required

You are responsible for reviewing your order before completing checkout.

By completing a purchase, you authorize our payment processor to charge the selected payment method for the amounts displayed at checkout.

6. Program Activation

An accepted application does not become an active website project until the applicant completes the required activation process.

Activation may require:

  • Reviewing the website offer
  • Selecting any desired optional upgrades
  • Accepting applicable terms
  • Purchasing the required Website Hosting & Care plan
  • Completing checkout
  • Creating or activating a customer account

Zurca is not required to begin website production until the required activation process has been completed.

7. Client Portal

Activated customers may receive access to a Zurca Client Portal.

The Client Portal may be used to:

  • View project status
  • Submit website content
  • Select a design direction
  • Provide domain information
  • Communicate with Zurca
  • Review website progress
  • Submit revision requests
  • Approve work
  • Review purchases or account information
  • Complete other project-related actions

You are responsible for providing accurate information through the Client Portal and for maintaining the confidentiality of your login credentials.

Activity submitted through your authenticated account may be treated as communication or authorization from you regarding your project.

8. Client Responsibilities

Timely completion of a website project depends on client cooperation.

You are responsible for providing information and materials reasonably necessary to complete your website, which may include:

  • Business name and contact information
  • Business description
  • Services or product information
  • Logo and branding materials
  • Photographs or other media
  • Domain information
  • Required legal or regulatory disclosures
  • Feedback and approvals
  • Other information reasonably required for your project

You represent that the information you provide is accurate to the best of your knowledge.

Project timelines may be delayed when required information, feedback, approvals, or content are not provided in a timely manner.

9. Website Content

Unless otherwise agreed in writing, you are responsible for the accuracy and legality of the content published on your website.

Zurca may assist with formatting, editing, organizing, or creating draft website content. This may include the use of software or artificial intelligence tools to assist with drafting or organizing content.

Any such content should be reviewed by you before final approval.

You are responsible for verifying:

  • Business information
  • Pricing
  • Product or service descriptions
  • Professional claims
  • Legal disclosures
  • Contact information
  • Industry-specific requirements
  • Any other factual information appearing on your website

Your approval of the website indicates your acceptance of the content presented at the time of approval.

10. Client-Provided Materials

By submitting text, photographs, logos, graphics, videos, trademarks, or other materials to Zurca, you represent that you own those materials or have the necessary rights and permissions to use them.

You grant Zurca permission to use, reproduce, resize, modify, format, and incorporate those materials as reasonably necessary to provide the requested services.

You agree not to provide materials that infringe the intellectual property, privacy, publicity, or other rights of another person or organization.

11. Design Direction

Zurca may present one or more design directions, examples, templates, or visual concepts to help establish the desired direction for your website.

Examples or previews are intended to communicate a general design direction.

Your final website may differ from the preview based on:

  • Your business content
  • Branding
  • Images
  • Website requirements
  • Responsive design considerations
  • Technical requirements
  • Accessibility or usability considerations
  • Development decisions

Selecting a design direction does not necessarily mean the final website will be an exact pixel-for-pixel reproduction of the example.

12. Revisions

The number of revision rounds included with your website project will be stated in your offer, project information, or Client Portal.

A revision round generally consists of a consolidated set of reasonable changes submitted after reviewing the current website version.

Revision requests should relate to the agreed project scope.

Requests that materially change the original scope may require an additional quote.

Examples may include:

  • Significant redesign after an approved design direction
  • Additional pages
  • Additional sections
  • New functionality
  • E-commerce
  • Membership functionality
  • Directories
  • Advanced booking systems
  • Custom applications
  • Complex integrations
  • Significant content creation
  • Other requirements outside the agreed scope

Additional work will not be performed as a paid upgrade without disclosure of the applicable cost.

13. Project Approval

When your website is ready for review, Zurca may request approval through the Client Portal, email, or another designated communication method.

You are responsible for reviewing the website before approval.

Approval indicates that you accept the website in its current form, subject to any separately agreed post-launch obligations.

Requests made after final approval or launch may be considered maintenance or additional development work and may be subject to additional charges.

14. Project Timelines

Any completion dates or time estimates provided by Zurca are estimates unless explicitly guaranteed in writing.

Website production may depend on:

  • Client response times
  • Content availability
  • Revision requests
  • Domain access
  • Third-party services
  • Technical requirements
  • Project complexity
  • Zurca’s production schedule
  • Events outside our reasonable control

Zurca is not responsible for delays caused by missing client materials, delayed approvals, third-party providers, or circumstances outside our reasonable control.

15. Inactive or Abandoned Projects

If a client stops responding or fails to provide required content, feedback, access, or approvals, Zurca may place the project On Hold.

We may attempt to contact you before doing so.

Projects that remain inactive for an extended period may require rescheduling based on current production availability before work resumes.

Zurca reserves the right to establish reasonable procedures for inactive or abandoned projects.

Recurring services such as hosting may continue independently of the website development schedule unless canceled in accordance with the applicable service terms.

16. Domain Names

Unless specifically included in your offer, domain registration is separate from the Free Website Program.

You may use:

  • A domain you already own
  • A new domain registered through an appropriate domain registrar
  • Another domain arrangement approved by Zurca

You are responsible for maintaining ownership and renewal of domains registered in your name unless Zurca expressly agrees to manage the domain on your behalf.

You may be required to provide temporary access or DNS information so Zurca can connect the website to your domain.

Zurca is not responsible for domain expiration, loss, or interruption resulting from a client’s failure to maintain domain registration or provide accurate account information.

17. Website Ownership

Subject to full payment of all amounts due, the client will receive rights to use the completed website produced specifically for the client’s business, subject to the third-party rights described below.

The website may incorporate:

  • WordPress
  • Themes
  • Plugins
  • Fonts
  • Stock assets
  • Open-source software
  • Third-party services
  • Licensed components
  • Zurca tools, systems, processes, or reusable components

These components remain subject to their respective licenses and are not transferred to the client beyond the rights provided by those licenses.

Zurca retains ownership of its pre-existing intellectual property, tools, workflows, software, methods, templates, reusable code, systems, and know-how.

18. Third-Party Software and Services

Websites may rely on third-party software or services, including WordPress, plugins, themes, APIs, hosting infrastructure, fonts, analytics platforms, payment systems, and other technologies.

Zurca does not control third-party providers and cannot guarantee that third-party products will remain available, unchanged, compatible, secure, or free of charge indefinitely.

Changes made by third-party providers may occasionally require updates, replacement products, configuration changes, or additional work.

Third-party products remain subject to their own licenses, terms, and privacy policies.

19. Website Hosting

Websites hosted through Zurca are subject to reasonable hosting and resource limitations.

You may not use Zurca hosting for unlawful, abusive, malicious, fraudulent, or technically harmful activity.

We may take reasonable action to protect our servers, infrastructure, customers, and reputation if a hosted website presents a security, legal, operational, or abuse risk.

20. Website Maintenance and Security

Website Hosting & Care is intended to help maintain the website and its underlying software.

However, no website or hosting environment can be guaranteed to be completely secure or uninterrupted.

Zurca does not guarantee that:

  • A website will never be hacked
  • Software will never contain vulnerabilities
  • Third-party services will never fail
  • Hosting will operate without interruption
  • Every software update will be compatible with every third-party component

We will use reasonable efforts to maintain services included in the applicable plan.

21. Search Engines and SEO

Zurca may implement basic technical or on-page SEO practices as part of website development where appropriate.

Unless a separate SEO service explicitly guarantees otherwise, Zurca does not guarantee:

  • Search engine rankings
  • First-page placement
  • Specific keyword positions
  • Search traffic levels
  • Leads or sales from organic search
  • Indexing within a specific period

Search engines independently determine how and whether websites are crawled, indexed, and ranked.

22. Advertising and Business Results

Zurca does not guarantee that a website will generate a particular number of:

  • Visitors
  • Leads
  • Phone calls
  • Appointments
  • Customers
  • Sales
  • Revenue

Business results depend on many factors outside Zurca’s control.

23. Cancellation of Recurring Services

You may request cancellation of recurring Website Hosting & Care services before the next renewal date.

Cancellation prevents future renewals but does not automatically create a refund for amounts already paid, except where required by law or expressly provided by Zurca.

If hosting is canceled, the website may eventually become unavailable on Zurca’s hosting infrastructure.

Before cancellation becomes effective, you are responsible for arranging alternative hosting if you wish to keep the website online elsewhere.

Where reasonably possible and subject to account status, applicable licenses, technical limitations, and amounts owed, Zurca may assist with providing or transferring website materials required for migration.

Migration or technical assistance beyond the applicable service scope may incur additional charges.

24. Refunds

Because website development and digital services involve labor, setup, infrastructure, and customized work, payments may become non-refundable once the applicable service has begun or resources have been committed.

Recurring hosting periods already purchased are generally non-refundable after the applicable service period has begun, except where required by law or where Zurca expressly agrees otherwise.

If a specific offer includes a different refund policy, the terms disclosed with that offer will control.

Nothing in these Terms limits any non-waivable rights you may have under applicable law.

25. Chargebacks and Payment Disputes

If you believe a charge is incorrect, please contact Zurca before initiating a chargeback so that we have an opportunity to investigate and resolve the issue.

Fraudulent or abusive payment disputes may result in suspension or termination of services, subject to applicable law and payment processor requirements.

26. Prohibited Uses

You may not use Zurca’s website or services to create, host, distribute, promote, or facilitate content or activity that:

  • Violates applicable law
  • Infringes intellectual property rights
  • Contains malicious software
  • Facilitates fraud or deception
  • Attempts unauthorized access to systems
  • Interferes with our infrastructure
  • Abuses our services or personnel
  • Violates the rights of others

Zurca reserves the right to refuse or discontinue services for projects that present reasonable legal, security, abuse, or reputational concerns.

27. Suspension or Termination

Zurca may suspend or terminate access to services when reasonably necessary because of:

  • Nonpayment
  • Fraud
  • Security concerns
  • Abuse
  • Illegal activity
  • Material violation of these Terms
  • Serious misuse of Zurca systems or infrastructure

Where reasonable under the circumstances, we may provide notice and an opportunity to resolve the issue.

28. Intellectual Property

The Zurca name, branding, website, original content, software, documentation, processes, graphics, and other proprietary materials are owned by Zurca or its licensors and are protected by applicable intellectual property laws.

These Terms do not grant permission to copy, reproduce, resell, or commercially exploit Zurca’s proprietary materials except as necessary to use the services provided to you.

29. Portfolio and Promotional Use

Unless otherwise agreed in writing, Zurca may identify completed website projects as examples of our work and may display publicly available portions of completed websites in our portfolio, proposals, social media, or marketing materials.

We will not intentionally publish confidential information submitted through your account or Client Portal for this purpose.

If you have a legitimate reason to request that your project not be displayed, please contact us.

30. Disclaimer of Warranties

To the extent permitted by applicable law, Zurca’s website and services are provided on an “as available” and “as is” basis, except for specific commitments expressly stated in writing.

Zurca makes no guarantee that every service will be uninterrupted, error-free, or suitable for every particular business purpose.

Nothing in this section excludes warranties or rights that cannot legally be excluded.

31. Limitation of Liability

To the maximum extent permitted by applicable law, Zurca will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to the use of our website or services, including loss of profits, revenue, business opportunities, goodwill, or data.

To the maximum extent permitted by applicable law, Zurca’s aggregate liability arising from a particular paid service will not exceed the amount paid to Zurca by the customer for the service giving rise to the claim during the twelve months preceding the event giving rise to the claim.

These limitations do not apply where liability cannot legally be limited or excluded.

32. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Zurca from third-party claims, liabilities, damages, and reasonable costs arising from:

  • Content or materials you provide
  • Your violation of another party’s intellectual property rights
  • Your unlawful use of the website or services
  • Your material violation of these Terms

This obligation does not apply to the extent a claim results from Zurca’s own unlawful conduct or negligence where liability cannot legally be excluded.

33. Privacy

Your use of Zurca’s website and services is also subject to our Privacy Policy.

Our Privacy Policy explains how we collect, use, and protect personal information.

Privacy Policy: https://zurca.com/privacy/

34. Changes to Services or Pricing

Zurca may modify services, features, program requirements, or pricing from time to time.

Changes to future pricing will not retroactively change amounts already paid.

For recurring services, we will provide notice of material pricing changes when required by applicable law or the terms of the applicable service.

Continued use or renewal after an applicable pricing change may constitute acceptance of the new price where permitted by law.

35. Changes to These Terms

We may update these Terms periodically to reflect changes to our services, business practices, technologies, or legal requirements.

The “Last Updated” date at the top of this page indicates the most recent revision.

Material changes will apply prospectively as required by applicable law.

36. Governing Law

These Terms will be governed by the laws applicable to Zurca’s principal place of business, without regard to conflict-of-law principles, except where applicable consumer protection law requires otherwise.

Any mandatory rights available to you under applicable law remain unaffected.

37. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

38. Entire Agreement

These Terms, together with the applicable website offer, checkout terms, Privacy Policy, and any written service agreement between you and Zurca, constitute the agreement governing the applicable services.

If a specific written agreement or offer expressly conflicts with these general Terms, the more specific terms will control for that service.
